PLEASE READ THE ENTIRE QUESTION BEFORE ANSWERING; PLEASE SITE YOUR REFERENCE FOR YOUR ANSWER.
It’s important to remember that anyone can sue anyone at anytime for anything. They may or may not win depending on the strength of their case. What I want to know is, "Is using public domain celebrity photos illegal, eventhough the sites say you can use them?" (I’m not talking about using them for profit.)

First you have to determine whether the images are in fact public domain. Any that are will be of celebrities who are long dead, and probably won’t generate much interest. The real question is whether the photographer is still living, what claims his/her estate has on the images to determine if the image is in fact in the public domain. Just because the website says so may not be legally accurate.

If the work has a commons license it can be used for not for profit fair use: News, education, satire, are a few uses. There are more. Read the link provided below. The trick is finding out if the commons license label is correct.

A site is a place while to cite is to give credit for the source of one’s information. Here’s mine:

Can I post a celebrity photo on my business website?
I am a dog trainer. I have a picture with a celebrity ( Cesar Milan) that I would like to post on my website in with some photos of seminars I have taken. ( caption saying that he inspires me and that he is not sponsoring by business… ) The photo was taken by my camera at one of his seminars. Can I do this? is it legal?

I think it’s fine as long as you are sure to say he does not sponsor your website or specifically support your website

I run a gossip blog and want to use celebrity photos. But I can´t find any good sites except buzzfoto. I am willing to pay money for the photos but I don´t want to pay more than $2 per image.

On AC 360 CNN uses the pictures of Obama taken in Hawaii to question whether Obama is a “celebrity” candidate, dredge up the McCain celebrity attack ads, use the occassion to compare him to Bill Clinton’s problems with Monica Lewinsky and ask if he can govern or not due to this all with the feigned concern over the safety of Obama and his family. If only they had given Bush the same scrutiny. This is a non-news story where these people just have to make up crap to be concerned about and call it news.

No. If it’s your shot. You have the sole right to sell it. If you want, you can put it at deviantart.com to be copyrighted or sell it online.
